Will of Anne Passell, 1730

In the Name of God Amen. I Anne Passel of Ashwel in the County of Hertford Widow being of a sound and disposing mind and memory ( for which I bless God) do make and ordain this my last Will and Testament in manner following, that is to say, Imprimis I give to my Daughter Elizabeth Passel the Feather Bed, Bedstead, and Bedding, a Chest of Drawers, sic Chairs, a Trunk of Linen & a Looking Glass now remaining and being in the best Chamber of my Dwelling House situate in Ashwel aforesaid And all other the Household Goods and Furniture being in the said Chamber and also six pair of hempen Sheets Item I give to my son Plomer six pairs of hempen Sheets, one Feather Bed, Bedstead and Bedding with the Green Curtains belonging to such Bed, Item I give to my Children, namely Robert and the said Elizabeth and Plomer all my silver plate to be equally divided between them share and share alike Item I give to the said Elizabeth my Daughter the sum of Eighty Pounds of lawful money of Great Britain to be paid to her at her age of twenty and one years or Day of her Marriage, which shall first happen, in lieu nevertheless of the like sum of Eighty Pounds given to her by Robert Passel her late Father decreed in and by his last Will and Testament Item I give to my said son Plomer Four Hundred Pounds of lawful money of Great Britain to be paid to him at his age of twenty and one years, in lieu nevertheless of the like sum of Four Hundred Pounds given to him by his Father the said Robert Passel in and by his last Will and Testament. And it is my mind and meaning that the said Robert Passel my son (one of the Executors of this my Will, hereafter named) shall pay to them the said Elizabeth and Plomer Interest for their several Legacyes immediately after my death till the sums shall respectively become payable, viz. to the said Elizabeth after the rate of five Pounds per Centum per Annum and to the said Plomer at the rate of four Pounds per Centum per Annum Item I give to the said Elizabeth and Plomer all such Debts as they do now or at my decease shall respectively owe me for Board or Maintenance or upon any other Amount whatsoever, so that my Executors shall make and demand thereof in anywise whatsoever Item I give to each of my Executors hereafter named a Ring of twenty shillings value Item I do hereby give and devise to my oldest Son the said Robert Passel All the Residue and Remainder of my personal Estate, my Debts and the aforesaid Legacyes being first paid and discharged And I give and devise to the said Robert Passel my son and his Heirs all and singular my Messuages Lands Tenements and Hereditaments lying or being in Ashwel aforesaid both Freehold and Copyhold having surrendered my Copyhold Estate to the case of my Will and all other my Lands and Tenements whatsoever charged and chargeable nevertheless with the Payment of all my Debts and Legacyes. And I do hereby occordingly charge all and singular the same Messuages Lands Tenements and Hereditaments with the payment of all my Debts and the aforesaid Legacyes And upon the payment thereof it is my mind and meaning that the said Elizabeth and Plomer shall and may respectively either upon their Same Messuages Lands Tenements and Hereditaments or any part thereof and receive the Rents Issues and Profits thereof till they shall respectively be paid and satisfied their said several Legacyes with the Interest and all [...] charges concerning the same And I do hereby nominate and appoint the said Robert my son and my Friend and Cousin Francis Littery of Baldock in the said County of Hertford Tallow chandler joint Executors of this my last Will and Testament Hereby revoking all other Wills by me made In Witness whereof I the said Anne Passel have to this my last Will and Testamnet contained in two Sheets of paper set my Hand to the first sheet and my Hand and Seal to the the last sheet thereof the eighteenth Day of June in the Fourth year of the reign of King George the Second and in the year of our Lord one thousand seven hundred and thirty.

A Codicil to be taken as and for part of my last Will and Testament I do hereby give to my Daughter Elizabeth Passell the Sum of twenty Pounds of lawful British Money to be paid to her within six Calendar Months next after my decease, over and above the Legacyes given to her in and by my last Will and Testament And I do hereby in all other things ratifie and confirm my said last Will and Testament In Witness whereof I have hereto set my Hand and Seal the Sixth Day of January Anno Dni 1732.

At Baldock December ye 20th 1736 Upon Robert Passell & Francis Lilly the two within named Executors [renouncing] their Claims Plomer Passell one of ye Legatees was then admitted to Administer and so forth & give a just Accompt being first sworn thereunto in due Form of Law before me Tho Smith Surrogate

The will was not proved in common form because the Executors therein named Did renounce the Execution thereof in writeing under their hands and seals But on the 20th of December 1736 The Revd Thomas Smith Clerk Surrogate of the Worshipfull John Andrew Doctor of Laws Comcy and Official in and throughout the whole Archdeaconry of Huntingdon &c granted letters of Adcon &c of the said Testator with his Will annexed unto Plomer Passell one of the Legatees within named being first sworn upon the holy Evangelists &c Saving &c.
